Hi, Steve Kirsh and Yogi here with the answer to today’s adoption question. The questions is: “We are thinking about an embryo donation process with our infertility doctor and the doctor said he would do the medical procedure and we do not have to worry about the legal stuff. What should we do?” And I would say, DON”T. Don’t do that. There is no statute in Indiana that makes the intended parents of a donated embryo the legal parents of the child. A fear of all adoptive parents, and in this case, intended parents of an embryo adoption, is that someone is going to try and take the child away from them after they complete the procedure. You want to have the legal protection of having a court determine that you are the legal parents of the child even though you are not the biological parents. So, yes it is a little bit more complicated, and yes, it is a little bit more expensive, but at the end of the day you will have a judicial determination that you are the legal parents of the child and you will not have to worry about anyone taking your child away from you. So, I would strongly recommend that you look into it with us. We know how to do it. We can walk you through the process. It is a little bit more expensive, it is a little bit more time consuming, but in the end it is a lot more secure. I hope that is helpful.
